A presiding Judge of the Kwadaso circuit court has warned against multiple sales of lands, saying persons accused of such acts will be dealt with according to the law.
Jephthah Appau, a Relieving Judge of the Asante Abuakwa circuit court in the Atwima Nwabiagya South Municipality, who gave the warning, reaffirmed the court’s decision to fight against multiple sales of lands in the country.
Speaking when a 46-year-old farmer, who has been charged for allegedly granting land without title, appeared before him at the Abuakwa circuit court, Mr Appau, pointed out that any person accused of multiple sales of land in any of his courts would be dealt with strictly according to the law, to deter others from such a wrongful act.
He said granting of a land without title was not only contrary to section 277 (2A) of the Lands Act 2020, Act 1036, but also disturbed buyers and dented the image of traditional authorities that owned the lands.
The plea of Nana Kofi Adade, alias Biney Solomon, was not taken and was remanded into prison custody to reappear before the court on September 12, this year, while investigations continue.
Police Detective Inspector Alexander Agbekpornu told the court that somewhere last year, Nana Adade sold plot number 45, which Yaa Amankwah, the complainant in the case, had already acquired from the late Nana Sarfo Akumah Abasi, the former chief of Tabere, near Abuakwa, at the cost of GH¢3,000 and was issued with an allocation paper and a site plan in the year 2001, to one Bernard Owusu Sarpong, for an amount of GH¢46,000, without title.
Prosecution indicated that in April this year, the complainant visited the plot and realised that it had been cleared together with her 10 trips of sand, a trip of chippings, 800 cement blocks, all valued at GH¢39,460 and her one-bedroom floor-level foundation valued at GH¢3,500 was damaged.
The complainant was informed that Owusu Sarpong bought the land from Nana Adade and one Akwasi Anane, now at large and cleared it.
A report was made to the Abuakwa police.
Nana Adade was arrested and, after preliminary investigations, charged and brought before the court.
